Abstract

Abstract: Indonesia according to the mandate of its constitution in the 1945 constitution makes it a state of law. In general, human rights are often heard in our ears about human rights violations that make us concerned about everything that happened, so we need to know more clearly about human rights. So from there it can be drawn the common thread that in criminal law we will imagine that he has a system of practical order which is commonly referred to as the criminal system and how the criminal policy is included in it. Thus we need to know how the criminal system is in the framework of an ideal criminal and human rights policy. This research is a normative juridical research, because it examines a norm, rule and statutory regulations. Thus the Criminal Law System Process within the Criminal and Human Rights Policy Framework explains that the existence of the rule of law is important. With this in mind, the existence of criminal offenders will improve by always referring to the principles on which the judicial process is enforced in the field.
